Strategic Power Watch — October 1, 2026

A material update is warranted. New evidence strengthens the assessment that SpaceX is receiving unusually privileged access to governmental information, regulatory support and strategic territory. It still does not demonstrate coordinated action among Musk, Thiel, Palantir and Anduril.

1. SpaceX reportedly receives exclusive classified orbital data

Credible reporting—not yet publicly documented

Breaking Defense reported on September 23, citing a Space Force official and roughly a dozen government and industry sources, that SpaceX signed an agreement exchanging data from its Stargaze satellite sensors for routine access to the Pentagon’s highest-fidelity orbital-tracking information.

The information reportedly includes classified covariance data previously kept mainly for internal military use. No other private company is said to receive comparable routine access for its own satellite operations. The agreement reportedly prohibits commercial use, but neither its text nor its oversight provisions are public. Space Force and SpaceX declined on-record comment.

Reasonable inference

This materially increases two indicators:

  • Intervention-resistant communications: SpaceX gains superior collision-avoidance and orbital-awareness capabilities for Starlink and Starshield.
  • Replacement of governmental functions: Stargaze already serves approximately 100 satellite operators and could evolve into a privately controlled substitute for part of the government’s civilian space-traffic-management function.

SpaceX is not merely receiving government contracts here. The government and company are combining classified state information with a privately owned sensor network consisting of approximately 30,000 cameras aboard Starlink satellites.

Allegation/speculation

Competitors allege that—even if direct commercial use is prohibited—the classified information could indirectly improve Stargaze and create an unfair market advantage. No source produced evidence that SpaceX has violated the contractual restriction or incorporated the classified data into services supplied to third parties.

2. The United States intervenes against foreign regulation of Musk and X

Verified fact

On September 24, the Justice Department formally asked to intervene before the EU General Court in support of Elon Musk and X’s attempt to annul a €120 million Digital Services Act penalty.

DOJ argued that the European Commission improperly extended its jurisdiction to Musk personally and to unrelated companies under his control. The filing was coordinated with the State Department. This is the first challenge to a DSA enforcement decision to reach the EU General Court.

Reasonable inference

This represents a moderate increase in state-provided regulatory insulation. The U.S. government is using sovereign diplomatic and legal capacity to defend Musk’s corporate structure against a foreign regulator.

The intervention is not proof of improper favoritism: DOJ frames it as protection for all U.S.-headquartered digital companies and an objection to extraterritorial regulation. Nevertheless, its practical beneficiary is Musk’s network of companies, and it potentially limits another sovereign’s ability to treat those companies as one Musk-controlled economic unit.

3. SpaceX clears the immediate obstacle to acquiring federal refuge land

Verified facts

A federal court refused to stop an exchange under which the Fish and Wildlife Service would transfer approximately 715 acres of federal wildlife-refuge land to SpaceX in return for approximately 683 acres of SpaceX land assessed by the agency as having higher conservation value.

SpaceX intends to expand its Massey testing facility, build a new service road and ultimately develop portions of the acquired property for industrial, infrastructure and residential uses. The court decided only the preliminary-injunction issues; it did not finally reject the underlying statutory claims.

DOJ characterized the transaction as supporting conservation, NASA and Air Force missions.

Assessment

This modestly increases the territorial facilitation indicator because federal land is being converted to private control to expand SpaceX’s integrated launch-and-manufacturing enclave.

It is not a grant of sovereignty or exemption from U.S. law. The exchange also has a documented conservation rationale, making it materially different from a concession of autonomous territory.

4. Countervailing development: five UK police forces end Palantir pilot

Verified fact

The East Midlands Special Operations Unit—covering five police forces—will terminate its Palantir Foundry pilot after the UK Home Office discontinued funding. The unit concluded that it would not proceed after assessing both operational value and future funding.

A separate seven-force regional pilot remains active, so this is not a nationwide Palantir withdrawal.

Assessment

This is limited but meaningful counterevidence to inevitable Palantir penetration of governmental functions. Public funding constraints, procurement scrutiny and local institutional decisions can still reverse deployments after testing.

Net change

  • SpaceX–state strategic integration: Clear increase.
  • Privileged access to sovereign information: Clear increase.
  • Protection from foreign regulation: Moderate increase.
  • Territorial or enclave-like capacity: Modest increase, without sovereign status.
  • Palantir governmental penetration: Limited decrease in UK policing.
  • Evidence of a coordinated Musk–Thiel–Palantir–Anduril network: No material increase.
  • Independent energy, semiconductor production, biotechnology, sanctions-resistant finance and new Argentina arrangements: No new verified development crossing the threshold.

The central concern has shifted slightly: the strongest current evidence is not private independence from government, but a progressively deeper fusion of one private corporate system—SpaceX—with sovereign military, informational, territorial and diplomatic power.
